Warranty Terms
Scope

 

At Q the Experience, we are committed to giving you all the assistance you may need to fully enjoy the many benefits that this innovative product can provide.

Please take your time to read through this warranty statement to familiarise yourself with the terms and conditions.

Terms and Conditions

 

Q the Experience will honour your early returned warranty card by providing you with an additional two months warranty with the exception of any consumables. The additional two months warranty will only apply if the warranty card is returned within 30 days of receipt of goods (strictly adhered to). Furthermore, we recommend extending your warranty, by purchasing a one or two year(s) Extended warranty within 30 days of date of purchase of the product. The extended warranty period, will be added to your records. (Proof of purchase and date is required).

 

Q The Experience Standard and Extended Warranty

Q The Experience agree, subject to the terms and conditions of this Standard Warranty and extended warranty specified below, to perform all necessary service(s) to the Q ENERGYspa® purchased by you, should the product not perform in accordance with its specifications during the Standard Warranty period of:

  1. 12 Months for the Economy Series 2 (e.g. 2100, 2500 and any future model in this range).

  2. 18 Months for the Home User Series 3 (e.g. 3024, 3100 and any future model in this range).

  3. 24 Months for the Professional/Consultant Series 4 (e.g. 4100, 4105 and any future model in this range).

  4. 3 Months for the ORB and Cable for home use and 2 Months if used in a clinic environment.

The Extended Warranty period of up to an additional 3 years on the product power supplies ONLY, providing that the extended warranty fee has been paid.

 

Standard Warranty Terms and Conditions

The Standard Warranty is the manufacturer's warranty that applies from the date of purchase, at no charge to the owner, for the Standard Warranty period as specified above. Conditions and exclusions are as listed below.

  1. The Standard Warranty only operates if proof of purchase - in the form of a bill of sale, invoice or purchase receipt - is presented at the time of the request for service.

  2. Any breakages and/or missing items upon delivery must be reported to the retail outlet within seven (7) days of receipt of the product.

Extended Warranty Terms and Conditions

You may at the point of purchase of this product and up to 30 days thereafter, elect to purchase the Extended Warranty.  This extended Warranty is subject to the same conditions and exclusions as listed below.

  1. The Extended Warranty period begins the day after the Standard Warranty period expires, provided that the Extended Warranty fees have been paid.

  2. In order for the Extended Warranty to take effect, the warranty card attached to this form must be retuned to the manufacturer for validation along with proof of purchase of such Extended Warranty in the form of a bill of sale, invoice or purchase receipt. 

Common Terms and Conditions

The Standard and Extended Warranty are in addition to all other conditions, warranties, guarantees, rights and remedies which may be implied by relevant legislation of Australia.

  1. The requested warranty service must be placed in the country in which the product is purchased.

  2. Q The Experience assumes no liability for damage or loss in shipment. All liability will rest with the owner whilst in transit to and from Q The Experience's authorised service centres.

  3. All shipping/freight/postage costs associated with this warranty must be prepaid, both ways.

  4. The owner must return any faulty product to be repaired to Q The Experience or an authorized repairer.

  5. The repair and/or replacement of any parts of the product will be at the option of Q The Experience. Q The Experience reserves the right to provide, at no extra cost, a more current upgraded model for replacement, if available.

  6. Q The Experience and it's service centres, may charge for labour, parts, transport and handling costs for work performed when the product is found to be in good working order, even if the product is under warranty.

  7. If Q The Experience deems any product failure, not covered under this warranty, the owner will be notified and an authorization and payment will be requested before any further repair(s) is undertaken.

  8. A description of the product malfunction or difficulty, plus the purchaser's details must be included with any warranty and/or other repairs.

  9. Authorisation must be obtained prior to returning a faulty product. An authorisation number (and address to service centre) is available from Q The Experience and must accompany the product upon the return.

Exclusions

The Standard and Extended Warranty will not extend to the following:

  1. If the product has not be installed, operated and/or maintained in accordance with the manufacturer’s instructions and recommendations contained in the operating manual provided with the product.

  2. In the event that the product has been, or is used, in a manner or for purposes, other than that for which the product was originally designed.

  3. Damage, malfunction or failure resulting from the use of incorrect voltages, alterations, accidents (including liquid spillage), any physical damage, misuse, neglect, abuse, faulty or improper installation, maladjustments of customer controls, main supply problems, fire, thunderstorm and lightning activity (including other damaging effects there from), inundation, infestation of insects or vermin, tampering by un-authorised persons or malfunctions resulting from the use of accessories which in the opinion of Q The Experience, are defective and/or incompatible with the product or exposure to abnormal corrosive conditions or any foreign object or matter in the product.

  4. Products, on which whose warranty/quality stickers, product serial number plates or electronic serial numbers have been removed, altered or rendered illegible by any means.

  5. Any situation or occurrence which is by legislation deemed as Force Majeure or the like.

  6. Any and all consumable products, accessories, documentation, including but not limited to all the rings and connecting track sets, plastic encasing, fuses, connecting cables, timing accessories and carry bag.

  7. To the extend permitted by relevant legislation in Australia, Q The Experience excludes any liabilities under the terms of the Standard and Extended Warranties for any indirect or consequential and/or loss of profits or loss of use or arising from the purchase or use of the product. This exclusion does not exclude Q The Experience's liability in respect of any warranties implied by relevant legislation of Australia.

  8. Q The Experience's total liability for damages for any cause related to or arising out of, the use or inability to use the product, whether in contract, negligence, strict tort or based on any other legal aspect, shall not exceed the original price paid for the product.

  9. In no case, shall Q The Experience be liable for any indirect special, incidental or consequential damages based upon breach of warranty, breach of contract, negligence, strict tort or any other legal theory. Such damages include, but are not limited to, loss of profits, loss of savings or revenues, inability to use the product or any associated equipment, cost of capital, cost of any substitute equipment, facilities or services, claims by third parties other than you, and injury to property.

  10. Transportation costs of the product or any parts thereof to and from the owner in connection with repairs, service, refitting, upgrading, removal or re-installation.

  11. Where in the opinion of Q The Experience, the product has been tampered with or repaired by anyone other than an authorised service centre or authorised individual.

  12. Customer instruction, installation, modification, conversion or setup adjustments.

  13. To service of any product outside the country in which the product was bought.

  14. All additional accessories and consumables purchased.

All Judgements, in all cases, situations and/or occurrences that arise, which are not listed herein, will be made at the discretion of Q The Experience, they will be final and absolute, no discussions will be entered into.

This warranty is understood to be the complete and exclusive agreement, superseding all prior agreements, oral or written, and all other communications in relation to the subject matter of this warranty. No Agent or Employee of Q The Experience may make modifications to this warranty and such representations will be void.
